We use personal information for purposes connected with the services you request, including:

4. Sensitive Personal Information

Some application information requires particular care, including Social Security numbers, government identification documents and financial account details.

We limit the use of this information to purposes reasonably connected with your application, verification, requested services, security, fraud prevention and applicable legal obligations.

  • Sensitive information should be submitted only through the application process or another method we specifically designate.

  • Do not send full Social Security numbers, banking credentials or identification documents in ordinary support emails.

  • We do not require your online banking password to evaluate a merchant application.

  • Any legally required additional notice or consent for sensitive information must be provided separately.

You may contact us with questions about why particular information is requested.

5. Disclosure to Processing Partners

Providing merchant services may require disclosure of application information to acquiring banks, payment processors, gateways and other relevant providers.

Depending on the application and service requested, information disclosed may include:

  • Applicant and business contact information.

  • Ownership and identification details.

  • Business formation and licensing documents.

  • Banking information and financial statements.

  • Processing history, transaction estimates and risk-related information.

  • Supporting documents needed to complete underwriting.

These disclosures support evaluation, account setup, verification and ongoing services. Submitting an application does not guarantee approval by any provider.

Some Processing Partners handle information independently under their own privacy notices and legal obligations. Their retention periods and procedures for privacy requests may differ from ours.

6. Other Disclosures of Information

We may also disclose information in the following circumstances:

  • Service Providers: To companies performing necessary services on our behalf, such as hosting, document management, communications, technical support and security.

  • Professional Advisers: To legal, accounting and other advisers where reasonably necessary and subject to appropriate confidentiality obligations.

  • Legal Requirements: In response to valid legal process, regulatory requests or other disclosures required or permitted by law.

  • Security and Fraud Prevention: Where reasonably necessary to investigate fraud, protect systems or address threats to individuals or businesses.

We seek to limit disclosures to information reasonably necessary for the relevant purpose.

7. Cookies and Similar Technologies

The Website may use cookies and similar technologies to support functionality, maintain form sessions, remember preferences and help protect against abuse.

If optional analytics or advertising technologies are used, their deployment must comply with applicable notice, consent and opt-out requirements.

  • Browser Controls: Most browsers allow you to block or delete cookies.

  • Website Functionality: Blocking certain cookies may affect application forms or other Website features.

  • Consent Choices: Where a cookie preference tool is provided, you may use it to manage available categories.

  • Privacy Signals: Where required by applicable law, we will recognize legally applicable browser-based opt-out signals, including Global Privacy Control.

  • Do Not Track: A browser’s “Do Not Track” setting may not have the same legal or technical effect as a recognized opt-out preference signal.

Browser settings do not replace an applicable right to submit a privacy request directly to us.

8. Marketing Communications

We may send information about our services where permitted by law.

  • You may opt out of promotional emails using an unsubscribe mechanism included in the message or by contacting us.

  • Opting out of marketing does not stop necessary communications about an application, active service, security issue or legal matter.

  • Providing a telephone number or accepting this policy does not, by itself, constitute consent to automated marketing calls or text messages.

  • Any marketing requiring separate consent must be supported by that consent.

  • If you receive text messages from us, you may use the opt-out instructions provided in those messages.

We will process marketing preferences in accordance with applicable requirements.

9. Payment Information and Merchant Customer Data

This Website primarily supports merchant inquiries and applications. Customers making purchases from a merchant should review that merchant’s privacy notice and the notices of the relevant payment providers.

  • Merchant Responsibility: Merchants are responsible for providing appropriate notices and obtaining any necessary authorizations for customer information they collect.

  • Support Requests: If customer or transaction information is needed to investigate an account issue, provide only what is necessary through the designated channel.

  • Card Security: Do not send full payment card numbers, card verification codes, PINs or passwords through ordinary email or general inquiry forms.

  • Separate Payment Systems: Payment information entered into a processor’s gateway or terminal is subject to that provider’s arrangements and applicable requirements.

This policy does not replace a merchant’s obligations to its own customers.

10. Data Retention

We retain personal information for as long as reasonably necessary for the purpose for which it was collected, subject to applicable legal and contractual requirements.

Retention decisions consider:

  • Whether an application remains active or requires follow-up.

  • Whether a service relationship is ongoing.

  • Requirements associated with underwriting and account administration.

  • Applicable financial, tax, regulatory and recordkeeping obligations.

  • Fraud prevention and security needs.

  • Actual or reasonably anticipated disputes and legal claims.

  • The sensitivity of the information and whether continued retention is necessary.

An unsuccessful or withdrawn application does not necessarily require immediate deletion of every record.

When information is no longer required, we take reasonable steps to delete, de-identify or otherwise dispose of it appropriately. Information in backups may remain until the applicable backup cycle expires, subject to access restrictions and legal requirements.

11. Information Security

We use reasonable administrative, technical and organizational safeguards appropriate to the nature of the information handled.

No website, transmission method or storage system can be guaranteed completely secure. This does not limit any security responsibilities imposed by law.

You can help protect your information by:

  • Using secure devices and trusted internet connections.

  • Confirming that you are using the correct Website before uploading documents.

  • Avoiding disclosure of passwords and unnecessary sensitive information.

  • Reporting suspicious messages or requests that appear to impersonate Voda Payments.

  • Promptly notifying us if you believe application information has been accessed or submitted without authorization.

If an incident triggers a legal notification obligation, we will provide the required notices.

12. Your Privacy Rights

Depending on your location, the applicable law and the information involved, you may have the right to:

  • Confirm whether we process personal information about you.

  • Request access to that information.

  • Request correction of inaccurate information.

  • Request deletion, subject to applicable exceptions.

  • Obtain a portable copy of certain information.

  • Withdraw consent where processing relies on consent.

  • Opt out of qualifying sales, targeted advertising or sharing, where applicable.

  • Restrict certain uses of sensitive personal information where the law provides that right.

  • Appeal a decision concerning a privacy request, where applicable.

These rights are subject to legal conditions and exemptions. Certain information handled in connection with financial services may be subject to different requirements.

13. Submitting a Privacy Request

To submit a request, email hayden@vodapayments.com with the subject line “Privacy Request.”

Please describe your request and provide sufficient information for us to identify the relevant relationship or application.

  • Verification: We may need to verify your identity before disclosing, correcting or deleting information.

  • Data Minimization: Do not include a full Social Security number, bank account number or identification document in your initial email.

  • Authorized Agents: Where permitted by law, an authorized agent may submit a request with appropriate evidence of authority.

  • Response Timing: We will respond within the period required by applicable law and communicate any permitted extension.

  • Exceptions: We may retain or withhold information where legally permitted or required, including to protect another person’s rights or preserve required records.

  • Appeals: Where an appeal right applies, reply to our decision stating that you wish to appeal.

  • No Unlawful Discrimination: We will not unlawfully discriminate against you for exercising an applicable privacy right.

If a request concerns an independent processor’s records, you may also need to contact that provider.

14. California and Other State Privacy Rights

Residents of California and other states may have additional rights where the relevant privacy law applies to Voda Payments and the information involved.

The categories of information, sources, purposes and recipients described in this policy explain our application-related information handling. They do not imply that every category is collected from every individual.

Where applicable, rights may include access, correction, deletion, portability, opt-out rights and limits on certain sensitive information uses.

Legal definitions of “sale,” “sharing” and “targeted advertising” can extend beyond exchanging information for money. The treatment of a particular disclosure depends on its purpose, the recipient’s role and applicable law.

You may contact us to ask about disclosures involving your information or exercise an applicable opt-out right. Where legally required, we will also honor recognized opt-out preference signals.

15. International Visitors

Voda Payments lists its business location in the United States. If you interact with us from another country, information may be processed in the United States or in other locations used by relevant service providers.

Privacy laws in those locations may differ from the laws where you reside.

Where applicable law requires safeguards or a specific legal basis for an international transfer, those requirements must be satisfied. Using the Website does not waive mandatory privacy rights or substitute for legally required transfer safeguards.

16. Children’s Privacy

Our merchant services are intended for adults acting in a business capacity. The Website is not directed to children under thirteen, and we do not knowingly collect personal information from children under thirteen.

If you believe a child has provided personal information to us, contact us so that we can investigate and take appropriate action.

17. Third-Party Websites and Services

Our Website or communications may link to third-party websites, payment platforms, document-signing services or other external tools.

Those providers have their own privacy notices and terms. We encourage you to review them before providing information.

A link or referral does not make Voda Payments responsible for an independent provider’s practices. This does not remove our responsibility for disclosures we make or obligations that otherwise apply to us.

18. Changes to This Privacy Policy

We may update this policy to reflect changes in our services, information handling practices or legal requirements.

Revisions will be posted on the Website. Where required, we will provide additional notice of material changes or obtain consent before using previously collected information for a materially different purpose.

An update does not remove rights or protections that apply under law.
